學(xué)前教育階段受教育權(quán)實現(xiàn)的國家限度研究

摘要: 學(xué)前教育階段受教育權(quán)是指學(xué)前兒童有接受文化教育和獲得受教育物質(zhì)幫助的權(quán)利,是憲法和法律賦予公民的基本權(quán)利?;趯W(xué)前教育權(quán)法律屬性的特點,在實現(xiàn)與保障幼兒學(xué)前教育權(quán)的過程中,國家應(yīng)尊重幼兒的學(xué)前教育選擇權(quán),發(fā)展公平而有質(zhì)量的學(xué)前教育,踐行自由基礎(chǔ)上的秩序價值,平衡私權(quán)與公權(quán)的關(guān)系,最大程度上保障幼兒接受學(xué)前教育的權(quán)利,使學(xué)前教育法成為名副其實的幼兒權(quán)益保障法。 The right to education in the stage of preschool education is that preschool-age children have the right to receive education and educational material assistance,which is the basic right of citizens given by constitution and the law. Based on the characteristics of the legal nature of the right to preschool education,in the process of realizing and guaranteeing the right to preschool education,the state should respect children's rights to choose preschool education,develop fair and quality preschool education,practice the order value on the basis of freedom,balance the relationship between private rights and public rights,guarantee the rights of preschool children to receive preschool education to the greatest extent,and make the preschool education law a real law for the protection of children's rights.
